SecretBall

  1. General provisions
  2. These Regulations set out the rules for conducting a contest called “SecretBall”.
  3. The Organizer shall conduct the contest in accordance with the Regulations, the rules and regulations of the Instagram Service and the provisions of generally applicable law.
  4. Instagram’s service administrator, META Inc. 1 Hacker Way, Menlo Park, CA 94025, United States, is not an organizer or sponsor of this Contest and is relieved of any responsibility for the organization of this Contest.
  5. The Organizer shall make these Regulations available on the Organizer’s Contest website available at secretball.co.uk/contest and at the Organizer’s headquarters.
  6. The Competition shall start on 01.06.2024 and end on 23.06.2024 at 20:59.
  7. The Organizer reserves the right to terminate the Contest before the date indicated in the paragraph above.
  8. The announcement of the end of the Competition shall be posted on the Organizer’s Competition website no later than 3 days before the scheduled end date.
  9. The Contest is carried out through the Organizer’s Contest website: secretball.pl/competition/, on the territory of the Republic of Poland.
  10. The Organizer declares that the Contest is not a game of chance, a fantasy lottery, a betting game, a promotional lottery, or a game whose outcome depends on chance.
  1. Entering the competition
  1. The participant in the competition can be a natural person, having full legal capacity and residing in the territory of the European Union member states.
  2. Entering the competition is voluntary and free of charge.
  3. To enter the competition, the following conditions must be met together:
    1. Placing an order, on the website of the Organizer’s Store, within 01.06.2024. Until 22.06.2024. to hrs. 23:59,
    2. Performing the contest task of: selecting the semifinalists of the 2024 European Football Championship for Men, the finalists of the 2024 European Football Championship for Men and the winner of the 2024 European Football Championship for Men; answering the contest question,
    3. Completion and submission of the application form, during the Contest.
  4. The application form is provided in the secretball.co.uk/contest website area.
  5. In order to access the website with the application form, it is necessary to have a data communication device with access to the Internet, a correctly configured web browser in the current or previous version: Microsoft Edge, Mozilla Firefox, Google Chrome, Safari or Opera, with JavaScript enabled.
  6. The prerequisite for the correct completion of the application form is the completion of all its mandatory and possibly optional fields, using true and complete data of the Participant.
  7. By posting an answer to a contest question for the purposes of the Contest, the Participant grants the Organizer authorization to use the given answer for the purpose of announcing information about the winner of the Contest, as well as for advertising and marketing purposes.
  8. Before submitting the application form, by checking the checkbox, the Participant should declare that he/she has read the Regulations and accepts their provisions.
  9. After submitting the application, the Participant is registered in the competition database. The participant will receive confirmation of the application, by receiving an email.
  10. Participants who do not meet the conditions specified in the Contest Regulations will be excluded from the Contest.
  11. A participant in the competition cannot be:
    1. Organizer’s staff member,
    2. A family member of the Organizer’s staff.
  1. Settlement of the competition and selection of winners
  1. Settlement of the competition will take place on 17.07.2024. At the headquarters of the Organizer. The result of the adjudication will be published on the day of the adjudication on the Organizer’s Instagram Profile.
  2. Participants who have met the entry criteria will be qualified to participate in the adjudication of the competition.
  3. The winner of the Contest is the Participant who correctly predicted the semifinalists of the 2024 European Football Championship for Men, the finalists of the 2024 European Football Championship for Men, the winner of the 2024 European Football Championship for Men and provided an answer to the contest question.
  4. In the case of a plurality of Participants who correctly made the typing referred to in the above paragraph, the jury established by the Organizer, based on its deliberations, will determine the winner of the main prize and four winners of the side prize.
  5. Settlement of the competition will be carried out with the participation of a jury established by the Organizer, which will select the winners on the basis of its deliberations.
  6. Winners will be notified of their winnings, on 18.07.2024, in an email sent to the email address provided in the entry form.
  1. Awards
  1. The grand prize winner will receive a PlayStation 5 Slim console and two premium mystery boxes,
  2. The winner of the side prize will receive a premium mystery box.
  3. The condition for the issuance of the prize is to provide a documented response to the information about winning the contest by the Participant, no later than 01.08.2024.
  4. In case of failure to send a response within the period indicated above, the entitlement to a given prize will pass to the next Participant, as decided on the basis of deliberations.
  5. The prize will be sent to the winner via courier, within 14 working days from the date of receipt of the documented response to the winner’s winning information.
  6. The participant who is the winner of the contest is responsible for calculating and paying the appropriate taxes and other public duties related to the receipt of the prize.
  7. The participant has the right to refuse the prize.
  8. The organizer has the right to decide on prizes that have not been claimed.
  1. Complaint – non-compliance of the provided service with the contract
  1. The Organizer establishes this complaint procedure.
  2. Complaints may be filed for non-compliance of the Service provided with the contract, in accordance with applicable law.
  3. Notification of complaints can be made by letter or e-mail to the postal, or electronic address of the Seller. They can be submitted using the form, the model of which is attached to the Regulations, but it is not mandatory.
  4. In the content of the complaint submitted, it is recommended to include:
    1. Participant’s Contact Information, which will be used to respond to the complaint and conduct correspondence related to it,
    2. description of the problem and identification data of the Consumer.
  5. The organizer will recognize complaints within 14 days from the date of application.
  6. The Organizer will inform the Consumer about the resolution of the received complaint by e-mail or regular mail, depending on the Consumer’s will or the method used by the Consumer to file the complaint.
  1. Out-of-court handling of complaints and redress of grievances
  1. The consumer has the opportunity to use the following out-of-court means of handling complaints and claims:
    1. submission of a request for settlement of a dispute arising from a concluded Sales agreement to a permanent conciliatory consumer court operating at the Trade Inspection, the address of which, due to its jurisdiction, can be determined using the website of the Office of Competition and Consumer Protection, maintained at the URL https://www.uokik.gov.pl/wazne_adresy.php#faq596,
    2. submission of a request for mediation proceedings for the amicable settlement of a dispute between the Consumer and the Seller to the provincial inspector of the Trade Inspection, whose address, given its jurisdiction, can be determined using the website of the Office of Competition and Consumer Protection, maintained at the URL https://www.uokik.gov.pl/wazne_adresy.php#faq595,
    3. use of the assistance of a district or municipal consumer ombudsman, or a social organization whose statutory tasks include consumer protection, filing a complaint through the EU online ODR platform, available at the URL http://ec.europa.eu/consumers/odr/,
    4. In accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council of May 21, 2013. On online consumer dispute resolution and amending Regulation (EC) No. 2006/2004 and Directive 2009/22/EC.
  2. Detailed information about the procedure for out-of-court ways of handling complaints and claims, as well as the rules of access to these procedures, can be found at the offices, and on the websites of the entities listed in point 1.
  3. A list of entities and institutions that perform tasks related to out-of-court resolution of consumer disputes and detailed information on this subject can be found on the website of the Office of Competition and Consumer Protection, available at the URL https://www.uokik.gov.pl
  1. Withdrawal from the contract
  1. A participant who is a Consumer or Entrepreneur on the rights of a Consumer may, without giving any reason, withdraw within 14 days from the contract, including the Sales contract, subject to the norms indicated in the content of the instruction on withdrawal from the contract, which is attached to the Regulations.
  2. To exercise the right of withdrawal, Consumers must inform the Organizer (SecretBall Kamil Korczak, 23/50 Lubuska St., 40-219 Katowice, e-mail: secretball.wygrajps5@gmail.com), about their decision to withdraw from the contract by an unequivocal statement (for example, a letter sent by mail or e-mail).
  3. The participant may withdraw from the contract by submitting a statement of withdrawal to the Organizer. The statement can be submitted on a form, the model of which is attached to the Regulations.
  4. In order to comply with the deadline for withdrawal, it is sufficient for the Consumer to send information on the exercise of the right of withdrawal before the expiry of the deadline for withdrawal.
  5. In the case of receipt by e-mail of the Consumer’s statement of withdrawal from the contract, the Organizer will immediately send an acknowledgment of receipt.
  6. In the event of withdrawal, the contract is considered not concluded.

  1. Validity and amendment of the regulations
  1. The Regulations enter into force on the date of their publication.
  2. The Organizer reserves the right to change the Terms and Conditions during the term by publishing a new version of the Terms and Conditions.
  3. Amendments to the Regulations may occur due to changes in the law, as well as due to technical or organizational changes concerning the essence of the competition or the manner in which it is conducted.
  1. Final provisions
  1. The organizer declares that the contest is not a game of chance, a lottery, a lottery, a betting game, a promotional lottery, a game whose outcome depends on chance, or any other form of activity, as provided for in the Law of November 19, 2009. on gambling.
  2. The Organizer is not responsible for the inability to notify the winner of the prize, if the Participant provides an incorrect e-mail address or changes it during the contest.
  3. Participants in the competition may at any time: access, record, obtain and reproduce the Regulations by printing or saving them on a data carrier.
  4. The provisions of the Regulations are not intended to exclude or limit the rights of Participants who are consumers under the provisions of generally applicable law. In the event of inconsistency of the Regulations with generally applicable laws, these laws shall apply.
  5. In the event that the provisions of the Regulations prove to be invalid or ineffective, this circumstance shall not affect the validity and effectiveness of the remaining provisions of the Regulations. Instead of the invalid or ineffective provisions, a standard corresponding to what the parties have agreed or what they would have agreed if they had included such a provision in the Regulations will apply.
  1. Definitions
  1. The Contest is a contest organized by the Organizer through the website secretball.co.uk/contest, under the conditions established in the Contest Regulations.
  2. A consumer is a Participant who is an individual and enters into a contract for a purpose not directly related to his/her commercial or professional activity.
  3. The Organizer of the Contest is Kamil Korczak, doing business under the name of SecretBall Kamil Korczak, based in Katowice (40-219) at ul. Lubuska 23/50 registered in the Central Register and Information on Business Activity kept by the Minister of Development and Technology, under NIP: 5472237686 and REGON: 525106077. The Organizer can be contacted at telephone number: 504 129 588 and using the e-mail address: secretball.wygrajps5@gmail.com.
  4. The Organizer’s profile is a website that appears on the Internet, available in the Service area at URL: instagram.com/secret.ball.
  5. Entrepreneur on the rights of a consumer is a Participant who is an entrepreneur, concluding an agreement related to his business activity, but which do not have a professional character for him, in accordance with the applicable laws arising in particular from the subject of his business activity on the basis of the provisions of the Central Registration and Information on Economic Activity, in accordance with the applicable laws.
  6. Rules of the Contest are these rules of the Contest, made available in the area of the Organizer’s Contest website. The Regulations set out the conditions for entry and participation in the Contest by its Participants.
  7. Terms of Service is the Terms of Service for the provision of electronic services in the instagram.com Internet domain area, made available in the area of its website.
  8. The service is an instagram.com website operated by Meta Inc. 1 Hacker Way, Menlo Park, CA 94025, United States at URL: instagram.com.
  9. The Organizer ‘s store is a store, operated through a website available on the Internet at URL: secretball.pl.
  10. A participant is a user of the Organizer’s Store who is a natural person who has entered the Contest, provided that he or she has legal capacity.
  11. The Service is a service provided by the Organizer to the User, on the basis of an Agreement concluded between the parties through the Organizer’s Contest website, within an organized system of concluding agreements at a distance, without the simultaneous physical presence of the parties.
  12. A User is an entity that enters into a Service Agreement with the Organizer, provided it has full legal capacity, or limited legal capacity in cases regulated by generally applicable law, or is a legal person or organizational unit
